H&!+  ` TheCourtinTapiaheldthatapplyingnewlawtocrimescommitted '(#- beforethelawseffectivedateconstitutedanimproperretroactiveapplicationofthestatute ifitdefinespastconductasacrime,increasesthepunishmentforsuchconduct,oreliminatesadefensetoacriminalcharge ,'3 basedonsuchconduct.(Tapia,supra,53Cal.3datp.288.)Insuchcases,  thelaw"change[s]thelegalconsequencesofanactcompletedbefore[thelaw's]effectivedate,"namelythedefendant'scriminalbehavior.(Ibid.)    ` WhiletheTapiacasedealtwiththeissueinthecontextof `  punishmentforacriminaloffense,asimilarrulehasbeenappliedwithrespecttocivilliabilities.Thus,in  AetnaCasualty&SuretyCo.v.Ind.Acc.    Com.(1947)30Cal.3d388,394,astatuteincreasingtheamountan `  employersliabilitytoanaccidentvictimcouldnotbeappliedtoanaccidentoccurringbeforethestatuteseffectivedatebecauseitchangedtheemployersliabilityfortheaccident.Likewise,Proposition51whichlimitedanindividualjointtortfeasor'sliabilityfornoneconomicdamages,couldnotbeappliedtopreexistingcausesofactionbecauseitalteredthelegalconsequencesofpastconductbychangingtheamountofdamagesthatcouldberecoveredfromvariousdefendants.(  Evangelatos,supra,44 P Cal.3datpp.12081209.)Whereastatuteissilentwithrespecttoretroactivity,astatutemaynotbeappliedretroactivelyifitimposesnewordifferentliabilityforpastconductitmattersnotwhetherthe liabilityiscriminalorcivilinnature. ` Ontheotherhand,wherethechangeinlawaffectsonly theconductoftrialswhichhaveyettotakeplacethestatuteisnotretroactive,evenifitisappliedtotheprosecutionofacrimecommittedbeforethelaw'seffectivedate.(Tapi  a,supra,53Cal.3datp.288.)Insuchcases,thelawis % * prospectiveinnaturebecauseitaddressesfutureconduct:theconductofthetrial.(Ibid.)Astatute"isnotmaderetroactivemerelybecauseitdraws (#. uponfactsexistingpriortoitsenactment.(Ibid.,quoting  Strauchv. 0*%0 SuperiorCourt(1980)107Cal.App.3d45,49;seealso,  ԀEstateofPatterson +'2 (1909)155Cal.626[amendmentofstatutegoverningproofofcontentsofwillattrialisprospectiveinnature];Strauch,supra,107Cal.App.3datp. @ 49[statuterequiringthefilingofcertificateofmeritinprofessionalmalpracticeactionisprospective].)  Thus, alawgoverningtheconductof `  trialsisbeingappliedprospectivelywhenitisappliedtoatrialoccurringafterthelaw'seffectivedate,regardlessofwhentheunderlyingcrimewascommittedortheunderlyingcauseofactionarose.(  Tapia,supra,53 `  Cal.3datp.289.) ` Intheinstantcase,nothingintheballotmaterialestablishingProposition83orthetextofSB1128statedimpositionofanindefinitetermwastobeappliedretroactively.Absentsuchexpressintent,statuteispresumedtooperateprospectively.(Tapia,supra,53Cal.3datp.287.) 0   TherequirementsinProposition83andSB1128thatdefendantsserve p indeterminatetermsalteredthelegalconsequencesandliabilitiesforappellantsactsandmentalconditionandthus,cannotbeappliedretrospectively. ` Priortotherevisionsto  section6604,appellantcouldonlybecommittedtoonetwoyeartermatatime.Attheendofeachterm,theburdenwasontheprosecutiontoprovebeyondareasonabledoubtthatappellantstillqualifiedforcommitment.Thus,therevision change[s]thelegalconsequencesofanactcompletedbefore[thelaw's]effectivedate(Tapia = ,supra,53Cal.3datp.288.)AppellantscommitmenttotheState % * DepartmentofMentalHealthwasanalogoustoalawincreasingthepunishmentforacrimeandisfarmoreburdensomethanmerelychanginglimitsofamonetaryrecoveryinacivilaction. ` Moreover,therequirementfordefendantstoserveanindeterminate +'2 termisnotarulegoverningtheconductoftrials.Suchrequirementneitheralterstheadmissibilityofevidence,norwhatfactsmustbeprovedtosustainapetition.Indeed,therequirementforthedefendanttoserveanindeterminatetermhasnoimpactwhatsoeveronhowanSVPtrialisconducted.ot ` Therefore,therequirementthatSVPdefendantsserveindeterminate    termscannotbeappliedtocasesinwhichthepetitionwasfiledpriortotheeffectivedateofSB1128.Whethertheoperativedateisthedateoftheoriginalpetitionin2004orthepresentpetitionforhiscontinuedcommitment,appellantscommitmentmustbegovernedbythelawsineffectpriortothemodificationsrequiringanindeterminateterm.Hence,appellantsindeterminatecommitmenttotheDepartmentofMentalHealthmustbemodifiedtoatwoyearcommitment.#ot_# p    P   IV.8 ` APPELLANTSINDETERMINATECOMMITMENT  UNDERTHEREVISEDSTATUTEVIOLATESTHEDUEPROCESSCLAUSEOFTHEFOUR  TEENTHAMENDMENTBECAUSETHEREVISEDSTATUTEIMPROPERLYPLACESTHEBURDENOFPROOFONTHEAPPELLANTTOPROVEHESHOULDBERELEASED. Q  ` ` x` x  - ` Asdescribedabove,  therevisedSVPAprovidesforanindeterminatecommitment.Asaconsequence,thegovernmentcannowavoidhavingtoprovethedetaineeremainsaSVPsimplybynotfilingapetitionrecommendinghisrelease.Withoutsucharecommendation,theburdenisonthedetaineetofileapetitionandprovethatheshouldnolongerbedetainedbyapreponderanceoftheevidence. ` Inthepresentcase,appellantwascommittedtotheDepartmentofMentalHealthforanindeterminatetermpursuanttotherevisedSVPA.Thejudgmentmustbereversedbecausetherevisedactviolatesappellantsrighttofederaldueprocessoflawunderthe  FourteenthAmendment. ` FreedomfromphysicalrestrainthasalwaysbeenatthecoreofthelibertyprotectedbytheDueProcessClausefromarbitrarygovernmentaction.( w Fouchav.Louisiana(1992)504U.S.71,80.)Suchfreedom,   howeverisnotabsolute. x ( x Hendricks,supra,521U.S.atp.356.) States @" haveincertainnarrowcircumstancesprovidedfortheforciblecivildetainmentofpeoplewhoareunabletocontroltheirbehaviorandwhotherebyposeadangertothepublichealthandsafety.(Id.atp.357.) #@(  ` IntheHendrickscase,UnitedStatesSupremeCourtheldthata % * Kansasstatute,similartoCaliforniasSVPApriortoitsrevision,containedsufficientconstitutionalsafeguardsastocomplywithfederaldueprocessrequirements.C(Hendricks,supra,521U.S.atp.346#CX#.)Inthisregard,the 0*%0 CourtnotedthattheKansasSVPstatuterequiredthestatetoprovebeyond +'2 areasonabledoubtthedefendantwasasexuallyviolentpredatorandtoallowthedefendantrighttoretainamentalhealthexpertatstateexpense.(Id.atp. x 353.)    ` Moreover,undertheKansasstatute,thecourtwasrequiredtoholdannualhearingstodeterminewhethertocontinuethecommitment.(C(Hendricks,supra,521U.S.atp.353#C #.)##ԀThus, [undertheKansaslawthe]    maximumamountoftimeanindividualcanbeincapacitatedpursuanttoasinglejudicialproceedingisoneyear.(Id.atp.364.)Inordertocontinue   thedetentionbeyondtheoneyear, acourtmustagaindeterminebeyondareasonabledoubtthatthedetaineesatisfiesthesamestandardsasrequiredfortheinitialconfinement.(Ibid.) P  ` Itistheseverysafeguards(i.e.,thelimiteddurationofthecommitment,periodicjudicialreview,requirementthatgovernmentproveneedforcontinuedcommitmentbeyondareasonabledoubt,andrighttoexpertsatstateexpense)whichwereabrogatedbytheProposition83modificationstotheCaliforniastatute.Thus,therationaleoftheHendricks  p opiniondemonstratesanindeterminatecommitmentviolatesdueprocessoflaw.(Seealso,#K #  Hubbart,supra,19Cal.4thatpp.11651167#A#Ԁ(upholding @" CaliforniasformerSVPA,notingcommitmentperiodwas relativelybrief!twoyears).) ` TherevisionsCaliforniasSVPAprovidetwomechanismsfor #@( judicialreviewofthedefendantsconfinement,neitherofwhichisconstitutionallyadequate.First,under  section6605,subdivision(b),theDepartmentofMentalHealthcanfileapetitionforthedetaineesdischargeorconditionalreleaseifitdeterminesthepersonnolongermeetsthedefinitionofaSVPorcanbereleasedtoaconditionalreleaseprogram. +'2 ThefilingofsuchapetitionisattheabsolutediscretionoftheDepartmentofMentalHealth.Onceapetitionisfiled,theburdenisonthestatetoprovebeyondareasonabledoubtthatthedefendantmeetsthedefinitionofasexuallyviolentpredator. ` Thegovernment,however,onlyhastheburdenofproofbeyondareasonabledoubtwhentheDepartmentofMentalHealthhasfiledthepetitionforrelease.Withtheexceptionoftheinitialpetition,thegovernmentcanpreventanyhearinginwhichithastheburdenofprovingbeyondareasonabledoubtthatthedefendanthasacurrent mentalillness,or mentalabnormality,whichmakeshimadangertothecommunityfromeverbeingheldbysimplynotfilingapetition. ` Second,apetitionfordischargemaybefiledbythedetaineepursuantto  section6608.Although,underSection6608,subdivision(a),thedetaineeisentitledtotheassistanceofcounsel,thesubdivisiondoesnotgrantthedetaineetherighttoanexpert.Moreover,thetrialcourtcansummarilydenythepetitionifitbelievesitisfrivolous.Thedetaineehastheburdenofprovingbyapreponderanceoftheevidencethatheshouldbeconditionallyreleasedorisnotasexuallyviolentpredator.(6608,subd.(i).)Undersection6608,thedetaineeisentitledtocounsel,butthesectionmakesnoprovisionfortheappointmentofamentalhealthexpert.ot ` #ot# [C]
