
Keeping Confidential Mail Confidential
Counsel has a duty to make all reasonable steps to keep communications with clients confidential. It has come to our attention that some prison facilities are opening attorney mail unless counsel complies strictly with the regulatons. Title 15, section 3141, subdivision (d) of the California Code of Regulations state that mail from counsel will not be opened outside the prisoner's presence if the envelope contains "the attorney's name, title, and return address ..." Many attorneys are failing to list their title.
